Terms of Service

These terms apply to Brick by Brick and to this website. By using the site or contributing to place a brick, you agree to them. If you do not agree, please do not use the service.

Brick by Brick is a commercial service, not a nonprofit, charity or fundraiser. A contribution buys a customized digital brick placement on a shared online wall. It is not a charitable donation and it is not tax-deductible.

What the service is

Brick by Brick is an online wall made of digital bricks. You customize a brick, choose your contribution, and pay through Stripe-hosted checkout. What you can submit is:

  • A display name of up to 20 characters, and — on a text brick — a short message of up to 60 characters.
  • A logo image on a logo brick: PNG, JPEG or WebP, up to 5 MB.
  • An optional website address, shown as a link on your published brick.
  • A brick finish, chosen from the finishes offered in the panel.

Paying does not publish your brick. Every submission stays private until a moderator reviews it and publishes it. Until then it is not visible on the public wall.

Placement is assigned by the platform. When you start checkout, the next available slot is reserved for you and given a brick number; you do not choose a position, a row or a neighbour. The wall’s visual layout, rendering, camera, ordering and presentation are ours to change, and we expect them to evolve.

Eligibility and authority

  • You must be at least 18 years old and legally able to enter into this agreement.
  • If you submit a business name, a logo, a trademark, a website address or any other content that belongs to someone else, you confirm that you are authorized to use it for this purpose.
  • You are responsible for everything submitted from your checkout.

Contributions and payment

  • Contributions are charged in US dollars through Stripe. The amount you choose is the amount you are charged; we add no separate fee.
  • A personal brick starts at $5. A brick that carries a logo or a link is a brand brick and starts at $15. We do not set a maximum, though the amount of any single payment remains subject to the limits our payment processor and your card issuer apply.
  • A brick with a link is a brand brick even when the brick itself is text, so the $15 minimum applies to it.
  • The exact amount is shown before you continue to checkout, and a contribution of $500 or more asks you to confirm the figure a second time.
  • Payment is taken on Stripe’s own hosted checkout page. Stripe processes your payment-card details; Brick by Brick does not receive or store full card numbers.
  • A reserved slot is held only for the life of the checkout session. If payment is not completed, the hold lapses and the slot returns to the wall for someone else. Nothing is charged.

Cancellations and refunds are covered by the Refund & Cancellation Policy, which forms part of these terms.

Review, moderation and removal

Every brick is reviewed before it is set into the wall. We may reject a submission, ask you to change it, decline to publish it, adjust formatting where that is necessary to render the brick, disable its link, or remove or replace content that is already published, where the content:

  • Is illegal, or promotes illegal activity.
  • Infringes a copyright, trademark or other intellectual-property right.
  • Is hateful, threatening, harassing or discriminatory.
  • Is sexually exploitative or explicitly pornographic.
  • Contains malware, a scam, a deceptive link, or impersonates a person or organization.
  • Publishes someone else’s personal information without their authorization.
  • Violates Stripe’s requirements or applicable law.
  • Materially harms the wall, the platform or its users.

We use this discretion for the reasons listed above, not arbitrarily. If we reject a submission during review, we refund it in full — see the Refund & Cancellation Policy. Removal of a published brick for breaking these rules does not automatically entitle you to a refund.

Your content, and the licence you give us

You keep ownership of everything you submit. You give Brick by Brick a non-exclusive, worldwide, royalty-free licence to store, process, resize, re-encode, render, display and distribute your submission for the purpose of operating and promoting the wall — including showing your brick on the public wall and in images or descriptions of it. The licence covers nothing else.

You confirm that your submission does not infringe anyone’s rights and does not break the content rules above.

If you believe a published brick infringes your intellectual property, email brickbybrickhello@gmail.com with a description of the work, the brick number or a link to it, and confirmation that you are the rights holder or authorized to act for them. We review these reports and remove or disable infringing content where the report is well founded.

The website, its code, its design, the wall system and the Brick by Brick name and branding remain ours.

  • A website address on a brick is a third-party link. We do not control, endorse, monitor or take responsibility for the site it points at.
  • We may disable a link that is unsafe, misleading, unavailable or in breach of these terms.
  • Following a link takes you outside this service, and the other site’s own terms and privacy practices apply.

Availability and how long a brick lasts

We intend to keep published bricks on the wall for as long as we operate the service, and we build it with that intention. We cannot promise forever, and we do not.

  • We do not guarantee uninterrupted or error-free access.
  • We do not guarantee perpetual hosting, or that the service will operate indefinitely.
  • We do not guarantee a fixed visual position, size, neighbour or camera framing for your brick.
  • Maintenance, security work, technical outages, provider failures and changes to how the wall is built and presented are all expected parts of running the service.

If we ever have to discontinue the service, we will use reasonable efforts to give notice on the website beforehand.

Using the site

  • Do not attempt to break, overload, probe or gain unauthorized access to the site, its database, its storage or the admin area.
  • Do not use automated means to reserve slots, submit bricks or interfere with other visitors.
  • Do not attempt to bypass moderation, payment or the content rules.

Disclaimer

The service is provided “as is” and “as available.” To the fullest extent permitted by law, Brick by Brick disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, secure or error-free, or that placing a brick will produce any particular result.

Limitation of liability

To the fullest extent permitted by law, Brick by Brick is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost business, lost data or lost goodwill, arising out of or relating to the service.

Our total liability for any claim relating to the service is limited to the amount you contributed for the brick the claim concerns, in the twelve months before the claim arose.

Some jurisdictions do not allow certain exclusions or limitations. Where that is the case, the exclusions and limitations above apply only as far as the law allows, and nothing in these terms limits liability that cannot lawfully be limited.

Indemnity

You agree to indemnify and hold Brick by Brick harmless from claims, damages, liabilities and reasonable legal costs arising from content you submit that is unlawful, infringes a third party’s rights, or breaks these terms.

Changes to these terms

We may update these terms as the service changes. The date at the top of this page shows when they were last revised, and the version posted here governs your use of the site from the moment it appears. If you continue to use the service after a change, you accept the updated terms.

Governing law and venue

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Los Angeles County, California have exclusive jurisdiction over any dispute arising out of them, and both you and Brick by Brick consent to that venue.

General

  • If any provision of these terms is found unenforceable, the rest stays in force and the unenforceable part is applied as far as the law allows.
  • Failing to enforce a provision is not a waiver of it.
  • These terms, together with the Privacy Policy and the Refund & Cancellation Policy, are the whole agreement between us about the service.
  • You may not transfer your rights under these terms without our consent. We may transfer ours in connection with a merger, acquisition or sale of the business.
